Welcome to Heartune. These Terms of Service ("Terms", "Agreement") govern your use of our website and digital services (collectively, the "Services"). By accessing or purchasing from Heartune, you agree to be bound by these Terms.

1. Overview

Heartune ("we", "us", "our") creates and delivers personalized digital songs based on your submitted story, message, or request. Our Services are designed to help you give or receive a one-of-a-kind song as a digital file.

By using our website or placing an order, you acknowledge that you have read, understood, and agreed to these Terms, along with our Privacy Policy, Refund Policy, and Delivery Information.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By purchasing from Heartune, you represent that you meet this age requirement.

3. Nature of the Product

All Heartune songs are digital, customized creations.

  • No physical products are shipped.
  • You will receive your personalized song through a private delivery page link sent to your email.
  • The creative process blends human curation with AI-assisted lyric writing and music production based on your input.
  • Each song is unique to your order and is not resold or reused for other customers.

4. Ordering and Delivery

  • Orders begin production once your personalization details are received and payment is confirmed.
  • Songs are typically delivered within 5 days for the Heartfelt package and within 24 hours for the Keepsake package, measured from the time you approve your lyrics.
  • Final songs are delivered as MP3 audio, accessible via a private delivery page link.
  • You will also receive a separate, shareable gift page link to send to the recipient.
  • We are not responsible for delays caused by missing or incomplete order details, late lyrics approval, or email delivery issues outside our control.

5. Pricing and Payment

All prices are listed in USD unless otherwise specified. Payments are processed securely through Shopify Payments, PayPal, or other approved gateways.

You agree to provide accurate billing information and authorize Heartune to charge your selected payment method for your order total.

6. Refund and Cancellation Policy

Each Heartune song is custom-made, so all sales are final once production has begun.

A short pre-production cancellation window applies, and one free song revision is included with every order. Full details, eligibility, and timing are in our Refund Policy, which is incorporated into these Terms by reference.

7. Ownership and Usage Rights

When you receive your finished Heartune song, the rights you receive depend on your package:

  • Heartfelt package — You receive a personal-use license. You may download, play, share with friends and family, and post your song on personal social media accounts. Commercial use (advertising, monetized content, film, broadcast, resale, paid streaming) is not included and requires a separate license. Contact us at hello@heartune.love.
  • Keepsake package — You receive a full commercial license. You may use your song in personal and commercial contexts, including advertising, social media (including monetized accounts), film, podcasts, and other paid content. Your song is exclusive to you and will not be sold or licensed to anyone else.

In all cases, you may not:

  • Resell, sublicense, or redistribute the underlying audio file as a stock or licensable asset.
  • Claim authorship of the song in a way that misrepresents how it was created.
  • Use the song for unlawful, hateful, or harassing purposes.

The story, names, and personal details you submit at checkout remain yours. Heartune does not claim ownership of your submitted content.

With your prior, opt-in consent, Heartune may use short, anonymized excerpts of completed songs for marketing or promotional purposes. We will never use your full song, your name, or identifying personal details for marketing without your written permission.

8. AI and the Creative Process

Heartune songs are created through a blended process that combines human creative direction with AI-assisted tools, including but not limited to large language models for lyric drafting and generative music models for composition.

By placing an order, you acknowledge that:

  • AI is used as part of the creative pipeline.
  • AI-assisted creative work involves natural variability — every song is unique, and we cannot guarantee an exact emotional, stylistic, or musical outcome.
  • The free revision included with your order is provided to address concerns about the final result. Subjective dissatisfaction (for example, "it didn't make them cry," "I imagined a different mood") is not grounds for a refund — see our Refund Policy.

9. Intellectual Property

All content on the Heartune website — including text, design, audio samples, brand marks, logos, and visuals — is the intellectual property of Heartune and may not be reproduced, copied, or used without written permission.

The Heartune name and logo are trademarks of Heartune.

10. Marketing, Advertising, and Analytics

We use cookies, pixels, and similar technologies for analytics and advertising through Google Ads, Meta (Facebook/Instagram), and Shopify Analytics.

By using our Services, you agree to the use of these technologies as described in our Privacy Policy, where you can also learn how to manage or opt out of personalized ads.

11. Limitation of Liability

To the fullest extent permitted by law, Heartune shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Delays in delivery caused by incomplete user input, late lyrics approval, or email deliverability issues.
  • Subjective dissatisfaction with artistic interpretation.
  • Losses resulting from unauthorized sharing of your digital files by you or by gift recipients.
  • Service interruptions caused by third-party providers (Shopify, Supabase, Anthropic, Suno, payment processors, email providers).

Total liability for any claim related to a single order shall not exceed the amount paid for that order.

12. Dispute Resolution

If you experience an issue, please contact us first at hello@heartune.love so we can resolve it promptly.

These Terms shall be governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes that cannot be resolved informally shall be brought before the courts of British Columbia, with venue in the appropriate small claims or superior court depending on the amount in dispute.

Both parties agree to attempt good-faith resolution before pursuing legal action.

13. Termination

We reserve the right to refuse, cancel, or terminate any order or account at our discretion, including in cases of fraud, abuse, chargebacks, harassment, violation of these Terms, or where the order content violates our content guidelines (for example, hateful, harassing, sexually explicit, or unlawful subject matter).

If your order is cancelled by us before production begins, you will receive a full refund. If cancelled after production has begun for cause (fraud, content violation), refunds may be partial or denied at our discretion.

14. Changes to Terms

We may update these Terms from time to time to reflect changes to our practices or services. The latest version will always be posted on this page with an updated "Last Updated" date.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
